Photographer/Applicant Terms of Service

1. Acceptance of Terms

By submitting an application, photographs, or any payment to The Curated Frame Photography Museum  (“the Museum,” “we,” “us,” or “our”), you (“Applicant,” “Photographer,” or “you”) agree to be bound by these Terms of Service.

If you do not agree to these terms, do not submit an application or payment.


2. Eligibility & Application

Photographers may apply for inclusion in the Museum by submitting:

  • An application form

  • Required photographic works and Artist Bio.

  • Provide links to all works and relevant public information for review.
  • An application fee of $150 USD, subject to partial refund as described below.

Submission does not guarantee acceptance.


3. Application Fee & Refund Policy

  • The application fee is $150 USD.

  • If your application is not accepted, the Museum reserves the right to refund up to $100 USD at its sole discretion.

  • Refund amounts (if any) are determined by administrative, review, and processing costs and the time it takes to conduct the review. If it is immediately apparent that the applicant will be denied, a full $100.00 will be refunded.

  • No refund is guaranteed.

  • If your application is accepted, the application fee is non-refundable.

  • Application Fee Waiver

    • Applicants with demonstrated financial hardship may apply for a partial or full application fee waiver.

    • Applicants must provide reasonable proof of financial hardship, which will be seen only by the reviewing staff member and immediately destroyed after review.

    • If a Photographer submits proof of financial hardship or any sensitive information via email, the Photographer acknowledges that email is not a secure method of transmission. The Photographer assumes all risk of interception, loss, or unauthorized access, and agrees to hold the Museum harmless from any claims or damages arising from the transmission of such information.
    • All waiver decisions are final and discretionary.


4. Acceptance & Exhibition Term

  • If accepted, your work is guaranteed to remain displayed in the Museum for one (1) full year from the date of acceptance.

  • The Museum retains curatorial discretion regarding layout, presentation, and placement.


5. Annual Maintenance Fee

  • A $75 USD maintenance fee is required to maintain your page after acceptance.

  • This fee covers:

    • Search engine optimization (SEO)

    • Page updates

    • Accuracy and content maintenance

  • Failure to pay the maintenance fee may result in the removal of your page and work from the Museum without refund.


6. Fee Waiver for Financial Hardship

Maintenance Fee Waiver

  • Photographers experiencing financial distress may apply for a maintenance fee waiver.

  • Approval is not guaranteed and is granted at the Museum’s sole discretion.

  • Applicants must provide reasonable proof of financial hardship. All information supplied will be immediately destroyed after review.

7. Intellectual Property Rights

  • You retain full copyright ownership of your submitted work.

  • By submitting work, you grant the Museum a non-exclusive, royalty-free license to display, reproduce, and promote your work solely in connection with the Museum, including marketing and promotional materials.

  • We credit the photographer for their work on any advertising when possible. It may be a rare occasion when it is not possible.
  • You confirm that you own the rights to all submitted works and that they do not infringe on any third-party rights.

  • The Photographer represents and warrants that they have obtained all necessary permissions, releases, and consents required for the submission and display of their work. The Museum does not verify model releases and is not responsible for claims arising from the subject matter of submitted works.

8. Removal & Termination

The Museum reserves the right to remove any content or terminate participation if:

  • Fees are unpaid

  • False or misleading information is provided

  • Submitted work violates laws or third-party rights

  • These Terms are violated

No refunds are required upon termination for cause.


9. No Guarantee of Exposure or Sales

The Museum does not guarantee:

  • Viewer traffic

  • Sales

  • Public recognition

  • Media exposure

Participation is for exhibition purposes only.


10. Limitation of Liability

To the fullest extent permitted by law, the Museum shall not be liable for:

  • Loss of income or opportunities

  • Technical issues

  • Website downtime

  • Third-party misuse of images


Portrait Photography, Model Releases & International Law Policy


Fine Art Portrait Photography

The Photography Museum is an online fine art museum. Many of the works exhibited include portrait photography intended for artistic, educational, and display purposes.

Because this museum is accessible internationally, photographers and applicants must understand that fine art exceptions are not universally recognized worldwide.


International Image & Personality Rights

Many countries recognize strong image rights, personality rights, or privacy rights, which may require a subject’s consent even when a photograph is presented as art.

In particular, countries including (but not limited to):

  • France
  • Germany
  • Spain
  • Italy
  • Japan
  • China
  • South Korea
  • Brazil

Photographer Responsibility

By submitting work to the Museum, the Photographer represents and warrants that:

  • They are the legal creator and rights holder of the submitted work.

  • The submission complies with all applicable local, national, and international laws.

  • Any required permissions, consents, or model releases have been obtained.

  • The work does not violate privacy, publicity, personality, or data protection rights.

  • The Museum does not verify model releases and relies entirely on the Photographer’s representations.
  • The Photographer is fully responsible for obtaining any required permissions or releases for all identifiable individuals in their work.
  • The Photographer agrees that the Museum is not liable for any claims, disputes, or legal issues arising from submitted works, and the Photographer assumes all risk related to image rights, privacy, and publicity.
  • If the Photographer does not have the proper permissions, model release or is unsure if they do, they should not submit thier work.

Model Release Policy

  • Model releases are recommended for all identifiable subjects

  • Model releases are required for:

    • Minors

    • Sensitive or intimate subject matter

    • Failure to obtain required permissions may result in the removal of the work. The Museum is not liable for any claims or disputes arising from these works and may remove any work at its discretion, including upon complaint by a subject or third party.
    • Submission of such works constitutes acceptance of all associated risks by the Photographer.

Nudes and Sensitive Content

  • The Photographer is fully responsible for obtaining all necessary permissions and releases for nudes and other sensitive subject matter.
  • The Museum is not liable for any claims or disputes arising from these works and may remove any work at its discretion, including upon complaint by a subject or third party.
  • Submission of such works constitutes acceptance of all associated risks by the photographer.

Right of Removal

The Museum may remove any submitted work at its sole discretion, including for legal, ethical, or reputational reasons, or upon complaint by a subject or third party. Removal may occur without refund.

Liability

All liability arising from submitted works rests solely with the Photographer.


Right of Removal (Important)

The Museum reserves the absolute right, at its sole discretion, to:

  • Request proof of consent or model releases

  • Remove any submitted work from display

  • Remove work upon complaint from a subject or third party

  • Remove work that presents legal, ethical, or reputational risk

Removal may occur without refund, including during the guaranteed exhibition period.


Limitation of Museum Liability

The Museum is not responsible for:

  • Claims arising from a lack of consent.

  • Legal disputes involving subjects in submitted works.

  • Differences in international laws regarding image rights.

All liability rests solely with the Photographer.


Changes to Terms

We reserve the right to update these Terms at any time. Continued participation constitutes acceptance of updated terms.

Acceptance of Policy

By submitting an application, images, or payment, the Photographer acknowledges and agrees to this policy in full.
